General Terms and Conditions

These General Terms and Conditions (GTC) apply to all orders placed via the online shop of [BM Intelligence GmbH] ("we", "seller") by consumers and businesses ("customer"). A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession.

The purchase contract is concluded with [BM Intelligence GmbH, Von-Vincke-Straße 54, 33014 Bad Driburg, Germany].

The presentation of products in the online shop does not constitute a binding offer but an invitation to place an order. By clicking the order button ("Buy now – order with obligation to pay"), you submit a binding offer to purchase the goods in your cart. We confirm receipt of your order by email immediately after sending. This confirmation of receipt does not yet constitute acceptance; the contract is concluded when we send a separate order/shipping confirmation or dispatch the goods. Before submitting the order you can review and correct your entries at any time using the browser and the on-screen correction functions.

All prices are total prices in Euro and include the statutory German value added tax. Shipping costs shown separately during the ordering process apply in addition. Details are on our Shipping & Payment page.

The payment methods available in checkout apply ([PayPal, credit card, Klarna, etc.]). Payment is due immediately upon conclusion of the contract unless otherwise agreed.

We deliver to [Germany / the EU / the countries listed at checkout]. Delivery times are stated on the product and Shipping page and are approximate unless expressly agreed as binding. The goods remain our property until full payment has been received.

Consumers have a statutory right of withdrawal as described in detail on our Right of Withdrawal page, which forms part of these terms.

The statutory warranty rights (Gewährleistung) apply. For consumers, the limitation period for defect claims on new goods is two years from delivery.

We are liable without limitation for intent and gross negligence and for injury to life, body or health. In case of slightly negligent breach of a material contractual obligation (cardinal obligation), our liability is limited to the foreseeable, typical damage. Otherwise liability for slight negligence is excluded. Liability under the Product Liability Act remains unaffected.

We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of their country of habitual residence. Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected.
